HelpCall service usage conditions and important notes

These Terms of Service (hereinafter 'these Terms') define the conditions for using HelpCall (hereinafter 'this Service') provided by Yononaka LLC (hereinafter 'the Company'). By using this Service, you are deemed to have agreed to these Terms.

Article 1 (Definitions)

The terms used in these Terms shall be defined as follows:

  1. "Service" refers to HelpCall (emergency alert service) provided by the Company.
  2. "User" refers to an individual who uses this Service.
  3. "Recording Data" refers to voice recordings registered by Users in this Service.
  4. "Emergency Contact" refers to the emergency contact phone number specified by the User.
  5. "Safety Check System" refers to a function that automatically notifies emergency contacts when there is no contact from the User by a set deadline.

Article 2 (Service Content)

This Service provides the following functions:

  1. Registration of recording data via phone and setting of emergency contacts and deadlines
  2. Confirmation of recording data from the website, and modification of emergency contacts and deadlines
  3. Automatic voice calling to emergency contacts when the set deadline is reached
  4. Emergency alert cancellation function (via incoming calls from the registered phone number)
  5. SMS reminder notifications before the deadline

Article 3 (User Registration)

  1. Use of this Service requires registration through methods designated by the Company.
  2. During registration, credit card information registration and validity verification will be performed.
  3. Payment will be processed upon completion of recording data registration.
  4. Registration with false information is prohibited.

Article 4 (Fees and Payment)

  1. The usage fee for this Service is 300 yen (tax included) per recording data registration.
  2. Payment is processed immediately upon completion of recording data registration.
  3. Payment method is limited to credit card only.
  4. Once payment is made, no refunds will be provided regardless of whether emergency alerts are executed.
  5. Re-recording functionality is not provided. Registering new recording data will incur an additional fee of 300 yen (tax included).
  6. Call and communication charges associated with using this Service are borne by the User.

Article 5 (Emergency Alert Function)

  1. When the set deadline is reached and there is no cancellation from the User, automatic calling to emergency contacts will be performed.
  2. Emergency alert cancellation is only possible through incoming calls from the registered phone number.
  3. Calls to emergency contacts are made from phone numbers designated by the Company.
  4. Appropriate voice playback is performed based on answering machine detection.
  5. If calls are unsuccessful, retries will be made at 30-minute intervals up to 3 times.

Article 6 (Prohibited Acts)

Users must not engage in the following acts:

  1. Acts of registering false information
  2. Acts of registering other people's phone numbers as emergency contacts without permission
  3. Acts of unauthorized access to this Service's systems
  4. Acts that interfere with the operation of this Service
  5. Acts of including content related to antisocial forces in recording data
  6. Acts that violate laws or are likely to violate laws
  7. Other acts that the Company deems inappropriate

Article 7 (Service Changes and Suspension)

  1. The Company may change the content of this Service or suspend its provision without prior notice to Users.
  2. This Service may be temporarily unavailable due to system maintenance, communication failures, etc.

Article 8 (Service Termination)

  1. The Company may suspend a User's use of the Service without prior notice if the User violates these Terms.
  2. Even in cases of service suspension, paid fees will not be refunded.

Article 9 (Disclaimer)

  1. This Service does not act as a substitute for emergency services (110/119, etc.).
  2. The Company assumes no responsibility if notifications to emergency contacts are delayed or fail to reach them.
  3. The Company assumes no responsibility if this Service becomes unavailable due to communication failures, system failures, etc.
  4. The Company assumes no responsibility for troubles arising between Users and third parties registered as emergency contacts.
  5. The Company's liability for damages arising from the use of this Service is limited to the amount of fees paid.

Article 10 (Data Storage and Deletion)

Recording data and related information are stored for the following periods:

  • When emergency alerts are cancelled: 1 month
  • When emergency alerts are executed: 1 year
  1. Data will be automatically deleted after the storage period expires.
  2. If Users request deletion, we will respond promptly within the scope of applicable laws.

Article 11 (Personal Information Handling)

Personal information handling follows the separately established "Privacy Policy".

Article 12 (Terms Modification)

  1. The Company may modify these Terms as necessary.
  2. When Terms are modified, they will be published on the website.
  3. If you continue to use this Service after modifications, you will be deemed to have agreed to the changes.

Article 13 (Governing Law and Jurisdiction)

  1. These Terms are governed by and interpreted in accordance with Japanese law.
  2. For disputes arising from this Service, Tokyo District Court shall be the court of exclusive agreed jurisdiction for the first instance.
